ST. LOUIS — A widower is suing Certain-Teed Corp., Crown Cork & Seal Co. Inc., CSR Ltd., and other asbestos products manufacturers, citing alleged negligence.
Jerry Capps, as surviving heir of Deborah Capps, deceased filed a complaint on Dec. 4 in the St. Louis 22nd Judicial Circuit Court against the defendants alleging that they failed to exercise reasonable care and caution for the safety of others.
According to the complaint, the plaintiff alleges that at various times during his and Deborah Capps' employment, they were exposed to asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. On July 14, 2015, Deborah Capps was diagnosed with mesothelioma, an asbestos-induced disease that allegedly was wrongfully caused. She died on Nov. 2, 2015.
The plaintiff holds the defendants responsible because they allegedly intentionally included asbestos fibers in their products when adequate substitutes were available, and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiff requests a trial by jury and seeks punitive and exemplary damages of more than $25,000. He is represented by Laci M. Whitley of Flint Law Firm LLC in Edwardsville.
