Former insulator claims makers of asbestos products to blame for cancer

Asbestos 03

ST. LOUIS — A former insulator is suing Crane Co., A.W. Chesterton Inc., BASF Corp. and other asbestos products manufacturers, citing alleged negligence.

Donald Loseman filed a complaint on Dec. 1 in the St. Louis Circuit Court against the defendants alleging that they breached their duties to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiff alleges that at various times during his employment as an insulator from 1955 to 1979, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. As a result, on Oct. 24 he was diagnosed with mesothelioma, an asbestos-induced disease.

The plaintiff holds the defendants responsible because they allegedly negligently included asbestos fibers in their products when adequate substitutes were available, and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff requests a trial by jury and seeks damages of more than $25,000, costs incurred for this action, and any further relief that are just and proper. He is represented by Andrew A. O'Brien, Christopher J. Thoron, Batholomew J. Baumstark, Gerald J. FitzGerald and Adam J. Reynolds of O'Brien Law Firm PC in St. Louis.
