Debt collector accused of violating Fair Debt Collection Act

ST. LOUIS — A St. Louis resident is suing a debt collector, citing alleged harassment and misrepresentation.

Cynthia Terry filed a complaint on Dec. 7 in the St. Louis Circuit Court against Randall Lang, d/b/a C.D.L. LLC, for alleged violation of the Fair Debt Collection Practices Act.

According to the complaint, Terry alleges that between Aug. 11 and Sept. 14 she was contacted by the defendant, who was attempting to collect a debt she allegedly owed to SWAATI Corp. Terry claims she received numerous phone calls from a man who identified himself as Charles Williams. He allegedly repeatedly told her she was involved in check fraud and would be arrested if she failed to repay the debt. 

As a result, Terry claims she experienced emotional distress, humiliation and loss of appetite. 

The plaintiff holds Lang responsible because the defendant allegedly used false, deceptive or misleading representation or means in connection with the collection of the debt.

The plaintiff requests a trial by jury and seeks judgment for actual and statutory damages in the amount of $1,000, plus costs of action, attorney fees, and all such additional and further relief as the court deems just and proper. She is represented by Robert L. Swearingen of Legal Services of Eastern Missouri in St. Louis.
