Evans Delivery, driver accused of negligence in accident

ST. LOUIS — A motorist is suing Demetrius Parker and Evans Delivery Company Inc., employer and employee, citing alleged negligence.

Donnell Witherspoon filed a complaint on Dec. 6 in the St. Louis Circuit Court against the defendants alleging that Parker breached his duty to exercise the highest degree of care in operating a motor vehicle.

According to the complaint, the plaintiff alleges that on June 27, 2016, he was operating his motor vehicle traveling northbound on Riverview Drive near its intersection with Hall Street when Parker, who was acting in the course and scope of his employment, negligently caused the semi-trailer-truck he was driving to collide with the plaintiff's vehicle. Witherspoon allegedly sustained serious and permanent injuries to his neck, shoulder, back, left leg, left knee and left ankle. 

The plaintiff holds Parker and Evans Delivery responsible becauseParker allegedly carelessly drove his vehicle at a dangerous speed, failed to give or sound any warning of its approach, and negligently drove the truck when he was medically unfit to do so.

The plaintiff requests a trial by jury; and seeks damages of more than $25,000, plus interest, and any further relief as the court may deem just and proper. He is represented by Jonathan D. Valentino and Todd R. Nissenholtz of Cofman Townsley LLP in St. Louis.
