Couple alleges asbestos manufacturers to blame for wife's cancer

Asbestos 06

ST. LOUIS — A husband and wife are suing Alliance Laundry Systems LLC,, Brunswick Corp., CBS Corp., and other asbestos products manufacturers, citing alleged negligence.

Patricia A. Palubiak and Donald T. Palubiak filed a complaint on Dec. 13 in the St. Louis Circuit Court against the defendants alleging that they breached their duties to exercise reasonable care for the safety of others.

According to the complaint, the plaintiffs allege that at some point during Patricia Palubiak's life, she was repeatedly exposed to and inhaled asbestos fiber dusts through her father Linord Cardwell and her husband Donald Palubiak, Her father and her husband worked with or around certain asbestos-containing products manufactured, sold, distributed or installed by the defendants.

On Nov. 8, Patricia Palubiak allegedly was told that she had developed mesothelioma, an asbestos-induced disease, and that the disease was wrongfully caused.

The plaintiffs hold  the defendants responsible because they allegedly intentionally included asbestos  in their products when they knew or should have known that it was toxic and poisonous, and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs request a trial by jury; and seek damages of more than $25,000, and such other and further relief that are just and proper. They are represented by T. Barton French and D'Arcy Reinhard of Maune, Raichle Hartley French & Mudd LLC in St. Louis.
