St. Louis Art Museum accused of discrimination

ST. LOUIS — A black employee is suing the St. Louis Art Museum Foundation and John Doe, former employers, citing alleged racial discrimination, retaliation and constructive eviction.

Andrea Poston filed a complaint on Dec. 15 in the St. Louis Circuit Court against the defendants alleging that while employed at the museum she was exposed to racially charged comments and was denied leave for a medical issue. She alleges the defendants violated Title I of the Civil Rights Act, and the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that as a result of the defendants' unlawful conduct, she was forced to resign from her employment on Dec. 18, 2015 because she was unable to take her FMLA leave. The plaintiff holds the defendants responsible because they allegedly subjected her to unlawful discrimination due to her race and took adverse employment actions.

The plaintiff requests a trial by jury; and seeks an award for loss wages and benefits and all other damages, plus interest, costs, and any other relief that are just and equitable. She is represented by Jaclyn M. Zimmermann of Ponder Zimmermann LLC in St. Louis.
