American Family Mutual Insurance allegedly breached contract

ST. LOUIS — A policy owner is suing an insurance company, citing alleged breach of contract.

Rita Freitas filed a complaint on Dec. 11 in the St. Louis Circuit Court against American Family Mutual Insurance Company alleging that the defendant breached the insurance contract by refusing to provide the fair value of the medical claim.

According to the complaint, the plaintiff alleges that on July 14 she was involved in a motor vehicle accident,  and was caused to incur medical and hospital expenses in the amount of $3,088. The plaintiff claims she was issued an insurance policy, which was in effect at the time of the accident, but was allegedly compensated for only $1,537.80 under a medical payments coverage limit of $5,000. 

The plaintiff holds American Family Mutual Insurance Company responsible because the defendant allegedly refused to pay and honor the policy owner's claim under Medical Payments coverage, and refuses to accept the Missouri statutes as written and pay the fair value of the claim or respond with reasonable promptness to the claim.

The plaintiff requests a trial by jury; and seeks judgment for damages incurred for an amount in excess of $25,000, together with interest, penalty for its vexatious refusal to pay, legal fees, expenses and costs expended. She is represented by Darin W. Sorrell of Sorrell & Traube in St. Louis.
