Woman alleges Carrier Corp., others' negligence caused lung cancer

ST. LOUIS – A woman alleges she was first exposed to asbestos fibers while living in Arkansas and is seeking damages from several manufacturers.

Patricia Morris and William Morris filed a complaint on April 11 in the St. Louis 22nd Judicial Circuit Court against Ace Hardware Corp., Carrier Corp., Bryan Steam LLC, et al. alleging negligence and other counts.

According to the complaint, Patricia Morris alleges she was exposed to asbestos fibers while living with her father and during her marriage through her husband. She alleges the exposure caused her to develop lung cancer, which was diagnosed on or about Nov. 15, 2016. 

The plaintiffs holds Ace Hardware Corp., Carrier Corp., Bryan Steam LLC, et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs request a trial by jury and seek damages of more than $25,000 against each defendant and any further relief as the court may deem just and equitable. They are represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
