ST. LOUIS – A property owner alleges a contractor failed to complete a project.
Lindsay Barth filed a complaint on April 20 in the St. Louis Circuit Court against Thomas M. Dunn Jr. and Dunn Lawn & Landscaping LLC alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges that on Aug. 22, 2016, defendant agreed to perform certain landscaping and construction services to renovate plaintiff's pool, pool deck and surroundings at her St. Louis home. She alleges the defendants' work had defects and that the defendants have failed to cure them. She alleges she paid $100,000 for the work and that it also remains incomplete.
The plaintiff holds Dunn Jr. and Dunn Lawn & Landscaping LLC responsible because the defendant allegedly failed to complete the project and failed to construct the pool properly.
The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus interest, costs and all further relief as the court may deem proper and just. She is represented by M. Quinn Murphy and Joseph F. Deveroux III of Sandberg Phoenix & Von Gontard PC in St. Louis.
