Man alleges father's lung cancer caused by asbestos in Riley Power, others products

ST. LOUIS – A son of a man formerly employed as a truck driver alleges his late father's lung cancer was caused by exposure to asbestos during his career.

Robert Buckholtz Jr., as the surviving heir of Robert Buckholtz Sr., deceased filed a complaint on June 1 in the St. Louis 22nd Judicial Circuit Court against Crown Cork & Seal Co. Inc., Ford Motor Co., Riley Power Inc., et al. alleging negligence and other counts.

According to the complaint, the plaintiff alleges that during Robert Buckholtz Sr.'s career from 1953 to 1982 as a truck driver, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. The suit states that on or about June 30, 2015, decedent first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. He died on March 28, 2016, the suit states. 

The plaintiff holds Crown Cork & Seal Co. Inc., Ford Motor Co., Riley Power Inc., et al responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory damages of more than $25,000, plus interest, costs and any further relief as the court deems appropriate. He is represented by Suvir Dhar of Simmons Hanly Conroy in Alton, Illinois.
