ST. LOUIS — A patient is suing SSM-SLUH Inc., St. Louis University Hospital and other healthcare providers, alleging insufficient measures were taken to prevent injuries.

Keith Miller filed a complaint on Feb. 15 in the St. Louis Circuit Court against the defendants alleging that they breached their duties to exercise the degree of care, skill and learning ordinarily used by medical professionals.

According to the complaint, the plaintiff was diagnosed with a concussion and traumatic brain injury on Dec. 15, 2015. As his headaches and memory loss intensified, he alleges he repeatedly asked for a brain scan to be done but says the healthcare providers repeatedly told him it was unnecessary and cost prohibitive. Finally, on March  10 he received a brain scan, which showed that he had a parieto-occipital epidural hematoma. He immediately was transferred to another hospital where he received emergency surgery to relieve pressure on his brain.

The plaintiff holds SSM-SLUH Inc., St. Louis University Hospital and others responsible because the defendants allegedly failed to properly diagnose and treat his brain condition.

The plaintiff requests a trial by jury; and seeks damages of more than $25,000, costs of this action and any further relief that the court may deem just. He is represented by Kenneth L. Halvachs and Ronald J. Abernathy of Halvachs & Abernathy LLC in Belleville.
